بيان صادر عن 292 منظمة حقوقية ومدنية
للإفارج عن الأسرى والمعتقلين الفلسطينيين في سجون دولة الاحتلال والفصل العنصري استمرار اعتقالهم انتهاك جسيم للقانون الدولي الإنساني

تدين المؤسسات الحقوقية والمدنية الموقعة أدناه بأقسى العبارات وأشدها استمرار اعتقال “إسارئيل”، الدولة القائمة بالاحتلال العسكري، لنحو (4650) أسيرا موزعين على حوالي (23) سجنا ومعتقلاً. من بين هؤلاء (32) أسيرة من النساء والفتيات، ونحو (180) قاصرا تقل أعمارهم عن ثمانية عشر عاماً، و(780) معتقلا إداريا من بينهم أسيرتان وأربع أطفال. كما يوجد (600) أسير يعانون أمراضاً مختلفة، منهم (22) أسيرا مصابا بالسرطان. هذا بالإضافة لوجود (549) من الأسرى صدرت بحقهم أحكاما بالسجن المؤبد مدى الحياة، لمرة واحدة أو لعدة مرات.

تطالب المؤسسات الحقوقية والمدنية المجتمع الدولي، وفي مقدمته منظمة الأمم المتحدة واللجنة الدولية للصليب الأحمر والفريق العامل المعني بالاحتجاز التعسفي، بالضغط على كيان الاحتلال والفصل العنصري لإنهاء ملف الاعتقال الإداري ووقف استخدامه بحق الفلسطينيين والفلسطينيات. هي بذلك تخرق أحد أهم ضمانات المحاكمة العادلة، في ظل إخفاء المعلومات عن المعتقل ومحاميه، وإمكانية تمديد اعتقاله الإداري لأجل غير مسمى دون علم المعتقل بتهمته.
إن ما يقارب (780) معتقلا إداريا، من بينهم أسيرتان وأربعة أطفال محتجزين دون تهمة.

علماً أن عدد أوامر الاعتقال الإداري الصادرة فقط منذ بداية العام 2022 لغاية الآن بلغت ما يقارب (1350) أمراً. ما يستوجب وقف هذه السياسة الممنهجة المستندة لقانون الطوارئ الاستعماري الملغى، ويفترض أوسع حملة تضامن دولية مع الأسرى الفلسطينيين عموماً، والأسرى الإداريين على وجه الخصوص. سيما وأن هناك (30) مضرباً عن الطعام منذ 25/9/2022، احتجاجاً على سياسة الإعتقال الإداري ودفاعا عن ال(780) معتقلاً إدارياً.

تؤكد المنظمات والمؤسسات الحقوقية والمدنية، أن استمرار اعتقال الأسرى الفلسطينيين، الذي يشكل انتهاكا جسيماً للقانون الدولي الإنساني، لاسيما اتفاقيتي جنيف الثالثة والرابعة بشأن معاملة أسرى الحرب والمعتقلين، هو أيضا جريمة حرب بحسب الفقرة الخامسة من المادة 85 من البروتوكول الأول لاتفاقيات جنيف، ووفقا للمادة الثامنة من نظام روما الأساسي للمحكمة الجنائية الدولية.
كذلك تؤكد أن ما يتعرض له الأسرى والمعتقلون الفلسطينيون من إعتقال تعسفي وتعذيب جسدي ونفسي وتعامل وعقوبات قاسية و/أو لاإنسانية ومهينة، ينتهك القانون الدولي لحقوق الإنسان انتهاكاً صارخاً وخاصة اتفاقية مناهضة التعذيب) (1984 -1987)، كما المعايير التي اعتمدها الفريق العامل المعني بالاحتجاز التعسفي.

تدين المؤسسات الحقوقية والمدنية سياسة الإهمال الطبي، التي تنتهجها دولة الاحتلال والفصل العنصري بحق الأسيرات والمعتقلات والأسرى والمعتقلين الفلسطينيين، وسياسة التعذيب والعزل الانفرادي في زنازين تفتقر لأدنى شروط الحياة الآدمية، وحرمان ذوي الأسرى من زياراتهم، وعمليات التنكيل والتعذيب الممنهجة التي يتعرض لها الأسرى والأسيرات.

تؤكد المنظمات الحقوقية والمدنية الموقعة على البيان على ضرورة:

1. دعوة المؤسسات الرسمية والحقوقية العربية والإقليمية والدولية للعمل على تدويل قضية الأسرى والمعتقلين الإداريين؛

2. تكثيف اللجنة الدولية للصليب الأحمر زياراتها للأسرى والمعتقلين الفلسطينيين، وفضح الممارسات التي تنتهك حقوقهم، ونشر التقارير للاطلاع عليها، والعمل على إطلاق سراحهم؛

3. إطلاق سراح الأسرى المرضى والأطفال والنساء والأسرى والمعتقلين الإداريين فورا؛

4. فتح سجون دولة الاحتلال والفصل العنصري أمام اللجان الطبية واللجان الحقوقية الدولية، ومن ضمنهم الفريق العامل المعني بالاحتجاز التعسفي؛

5. دعوة الدول المتعاقدة على اتفاقيات جنيف لإلزام دولة الاحتلال والفصل العنصري، بموجب المادة الأولى المشتركة، احترام التزاماتها وفق اتفاقيا ت جنيف الثالثة والرابعة لحماية الأسرى والمدنيين؛

6. مطالبة لجنة تقصي الحقائق الخاصة بالأراضي المحتلة دراسة حالة الأسرى والأسيرات في السجون الخاصة بالمحتل، ومناقشتها مع المفوض السامي لحقوق الإنسان في جنيف؛

7. ممارسة المقررين الأمميين الخاصين لمسؤولياتهم في إعداد التقارير العاجلة وتسليط الضوء على انتهاكات حقوق الأسرى الفلسطينيين في الصحة والرعاية، وفضح ممارسات دولة الإحتلال والفصل العنصري، بما يمكن من مساءلتها ويشكل نوعا من الردع لها؛

8. مطالبة الأمم المتحدة ومجلس حقوق الإنسان بعقد جلسة استثنائية لمناقشة أحوال الأسرى والمعتقلين الفلسطينيين في السجون الإسرائيلية.

Statement Issued by 292 Human Rights and Civil Organizations for the release of Palestinian Prisoners and Detainees in the Prisons of the
Occupation and Apartheid state
Their Continued Detention is a Grave Violation of International Humanitarian Law

The undersigned human rights and civil institutions condemn in the strongest terms the continued detention by “Israel”, the military occupation state, of about (4,650) prisoners distributed among about (23) prisons and detention center. Among the prisoners there are (32) female and girl captives, about (180) minors under the age of eighteen years, and (780) administrative detainees, including two female prisoners and four children. There are also (600) prisoners suffering from various diseases, of whom (22) have cancer. This is in addition to (549) prisoners who were sentenced to life imprisonment, once or several times .

Civil and human rights organizations call on the international community, led by the United Nations, the International Committee of the Red Cross and the Working Group on Arbitrary Detention, to pressure the occupation and apartheid entity to end the file of administrative detention and stop its use against Palestinians. Thus, it violates one of the most important fair trial guarantees, in light of the concealment of information from the detainee and his lawyer, and the possibility of extending his administrative detention indefinitely without the detainee knowing his accusation.
About (780) administrative detainees, including two female prisoners and four children, are being held without charge. Noting that the number of administrative detention orders issued only since the beginning of 2022 until now has reached approximately (1350). This requires stopping this systematic policy based on the abolished colonial emergency law, and presumes the widest international campaign of solidarity with Palestinian prisoners in general and administrative prisoners in particular. Especially since there have been (30) hunger strikers since September 25th, 2022, in protest against the administrative detention policy and in defense of the (780) administrative detainees.

Civil and human rights organizations and institutions affirm that the continued detention of Palestinian prisoners, which constitutes a grave violation of international humanitarian law, especially the Third and Fourth Geneva Conventions on the treatment of prisoners of war and detainees, is also a war crime according to Article 85, Paragraph 5 of Protocol I to the Geneva Conventions, and in accordance with Article 8 of the Rome Statute of the International Criminal Court .
It also affirms that what Palestinian prisoners and detainees are subjected to in terms of arbitrary arrest, physical and psychological torture, and cruel, inhuman, and degrading treatment and punishment, flagrantly violates international human rights law, especially the Convention against Torture (1984-1987), as well as the standards adopted by the Working Group on Arbitrary Detention .

Human rights and civil institutions condemn the policy of medical neglect and apartheid pursued by the occupying state against Palestinian female prisoners, detainees, and the policy of torture and solitary confinement in cells lacking the minimum conditions of human life, depriving the families of prisoners of their visits, and the systematic abuse and torture of male and female prisoners .
The human rights and civil organizations that signed the statement stress the need to:
1. Inviting Arab, regiona,l and international official and human rights institutions to work on the internationalization of the issue of prisoners and administrative detainees;
2. The International Committee of the Red Cross intensifies its visits to Palestinian prisoners and detainees, to expose practices that violate their rights, and publishe reports for review, and works for their release;
3. Immediately release sick prisoners, children, women, and administrative detainees;
4. Opening the prisons of the occupying and apartheid state to medical and international human rights committees, including the Working Group on Arbitrary Detention;
5. Calling upon the member states to the Geneva Conventions to oblige the occupying and apartheid state, under Common Article 1, to respect their obligations under the Third and Fourth Geneva Conventions to protect prisoners and civilians;
6. Demanding the Commission of Inquiry on the Occupied Territories to study the situation of male and female prisoners in the prisons of the occupier, and to discuss it with the High Commissioner for Human Rights in Geneva;
7. The UN Special Rapporteurs exercise their responsibilities in preparing urgent reports and highlighting violations of the rights of Palestinian prisoners to health and care, and exposing the practices of the occupying and apartheid state, in a way that enables it to be held accountable and constitutes a form of deterrence;
8. Demanding the United Nations and the Human Rights Council to hold an extraordinary session to discuss the conditions of Palestinian prisoners and detainees in Israeli prisons .

Déclaration publiée par 242 organisations de la société civile et de défense des droits humains : nous appelons à la libération des prisonniers de guerre et des prisonniers politiques palestiniens détenus dans les prisons de l’Etat d’occupation et d’apartheid:
leur maintien en détention constitue une grave violation du droit international humanitaire.

Les organisations de la société civile et de défense des droits humains soussignées condamnent dans les termes les plus forts la détention par “Israël”, Etat d’occupation militaire et d’apartheid, de 4.650 prisonniers répartis dans environ 23 prisons et centres de detention.
Parmi les prisonniers, il y a 32 femmes détenues (de tous âges), environ 180 mineurs (de moins de dix-huit ans), et 780 détenus administratifs (dont deux femmes et quatre enfants) .
Pour ce qui est de leur situation sanitaire, ce sont 600 prisonniers qui souffrent de diverses maladies, (dont 22 sont atteints de cancer). 549 détenus sont condamnés (une ou plusieurs fois).à la prison à perpétuité.

Les organisations de la société civile et de défense des droits de l’homme soussignées appellent la communauté internationale – sous l’égide des Nations Unies, du Comité international de la Croix-Rouge et du Groupe de travail sur la détention arbitraire – à faire pression sur l’entité d’occupation et d’apartheid pour qu’elle abolisse le régime de la détention administrative et cesse de la pratiquer contre les Palestiniens. Ce régime viole l’une des plus importantes garanties du procès équitable, du fait de la dissimulation, à la connaissance du détenu et à son avocat, des informations concernant les motifs de l’emprisonnement. De plus toute peine de détention administrative – prononcée par une juridiction militaire – peut être indéfiniment renouvelée, sans même que le détenu ne connaisse la substance de l’acte d’accusation qui le vise.
Ainsi, environ 780 personnes sont en détention administrative – dont deux femmes et quatre enfants – sans qu’aucune charge ne leur ait été signifiée.
À noter: les peines de détention administrative prononcées depuis le début de 2022 jusqu’à aujourd’hui ont atteint le nombre d’environ 1350.
Il est grand temps de mettre fin à cette politique systématique qui tire son origine de l’époque coloniale britannique lorsqu’était décrétée l’état d’urgence sous occupation militaire. L’abolition du régime de la détention administrative nécessite la plus large campagne internationale de solidarité avec les prisonniers palestiniens en général, et en particulier avec les prisonniers administratifs .
Depuis le 25 Septembre, une grève de la faim a été déclenchée par 30 détenus administratifs, pour protester contre la politique de détention administrative dont ils sont victimes, eux et les 780 prisonniers victimes du même régime de detention.

Les organisations de la société civiles et de défense des droits de l’homme signataires affirment que le maintien en détention administrative des prisonniers palestiniens constitue une grave violation du droit international humanitaire – notamment au titre des dispositions des troisième et quatrième Conventions de Genève qui régissent le traitement des prisonniers de guerre et des civils détenus. Cette pratique est un crime de guerre selon l’article 85, paragraphe 5 du Protocole I des Conventions de Genève, et aussi conformément à l’article 8 du Statut de Rome de la Cour pénale international. Les instances signataires affirment également que les arrestations arbitraires, les tortures physiques et psychologiques, les peines et traitements cruels, inhumains et dégradants subis par les prisonniers et détenus palestiniens constituent une violation flagrante du droit international des droits de l’homme, en particulier de la Convention contre la torture (1984-1987), ainsi que des normes adoptées par le Groupe de travail sur la détention arbitraire.

Les signataires, associations de défense des droits de l’homme et autres instances de la société civile, condamnent la politique de négligence médicale et d’apartheid menée à l’encontre des femmes palestiniennes prisonnières et détenues par l’Etat d’occupation, ainsi que sa politique de torture et d’isolement dans des cellules dépourvues des conditions élémentaires de vie, privant les familles des prisonniers de leur droit de visite Les abus systématiques commis contre les prisonniers et en particulier l’usage de la torture concernent aussi bien les hommes que les femmes.

Les organisations de défense des droits de l’homme et les organisations de la société civile signataires soulignent la nécessité 1.d’inviter les institutions officielles et de défense des droits de l’homme arabes, régionales et mondiales à travailler à l’internationalisation de la question des prisonniers ;palestiniens en général et des détenus administratifs en particulier

6.Demandent à la Commission d’enquête sur les territoires occupés d’étudier la situation des prisonniers, hommes et femmes, dans les prisons de l’occupant, afin d’en discuter avec le Haut Commissaire ;aux Droits de l’Homme à Genève

Su detención continuada es una grave violación del derecho internacional humanitario

Las organizaciones abajo firmantes de derechos humanos e instituciones civiles condenan en los términos más enérgicos la detención continua por parte de “Israel”, el estado de ocupación militar, de unos (4.650) prisioneros distribuidos entre unas (23) prisiones y centros de detención. Entre los presos hay (32) mujeres y niñas cautivas, alrededor de (180) menores de dieciocho años y (780) administrativos detenidos, incluidas dos reclusas y cuatro niños. También hay (600) presos que sufren de diversas enfermedades, de los cuales (22) tienen cáncer. Esto se suma a (549) presos que fueron condenados a cadena perpetua, una o varias veces .

Las organizaciones civiles y de derechos humanos hacen un llamamiento a la comunidad internacional, encabezada por las Naciones Unidas, el Comité Internacional de la Cruz Roja y el Grupo de Trabajo sobre la Detención Arbitraria, para que presione a la entidad de ocupación y apartheid para que ponga fin al expediente de detención administrativa y ponga fin a su uso contra los palestinos. Por lo tanto, viola una de las garantías más importantes de un juicio justo, a la luz de la ocultación de información al detenido y a su abogado, y la posibilidad de extender su detención administrativa indefinidamente sin que el detenido conozca su acusación.
Alrededor de (780) detenidos administrativos, entre ellos dos reclusas y cuatro niños, están detenidos sin cargos. Señalando que el número de órdenes de detención administrativa emitidas solo desde principios de 2022 hasta ahora ha alcanzado aproximadamente (1350). Esto requiere detener esta política sistemática basada en la abolida ley de emergencia colonial, y supone la más amplia campaña internacional de solidaridad con los prisioneros palestinos en general y los presos administrativos en particular. Especialmente porque ha habido (30) huelguistas de hambre desde el 25de septiembre de 2022, en protesta contra la política de detención administrativa y en defensa de los (780) detenidos administrativos.

Las organizaciones e instituciones civiles y de derechos humanos afirman que la detención continuada de prisioneros palestinos, que constituye una grave violación del derecho internacional humanitario, especialmente de los Convenios de Ginebra Tercero y Cuarto sobre el trato de los prisioneros de guerra y los detenidos, es también un crimen de guerra de conformidad con el párrafo 5 del artículo 85 del Protocolo I de los Convenios de Ginebra. y de conformidad con el Artículo 8 del Estatuto de Roma de la Corte Penal Internacional .
También afirman que lo que los prisioneros y detenidos palestinos son sometidos en términos de detención arbitraria, tortura física y psicológica, y tratos y penas crueles, inhumanos y degradantes, viola flagrantemente el derecho internacional de los derechos humanos, especialmente la Convención contra la Tortura (1984-1987), así como las normas adoptadas por el Grupo de Trabajo sobre la Detención Arbitraria .

Los derechos humanos y las instituciones civiles condenan la política de negligencia médica y apartheid aplicada por el Estado ocupante contra las prisioneras palestinas, detenidas y la política de tortura y confinamiento solitario en celdas que carecen de las condiciones mínimas de vida humana, privando a las familias de los prisioneros de sus visitas, y el abuso y la tortura sistemáticos de prisioneros y prisioneras .

Las organizaciones civiles y de derechos humanos que firman la declaración subrayan la necesidad de:

1. Invitar a las instituciones oficiales y de derechos humanos árabes, regionales e internacionales a que trabajen en la internacionalización de la cuestión de los presos y los detenidos administrativos;
2. El Comité Internacional de la Cruz Roja precisa intensificar sus visitas a los prisioneros y detenidos palestinos, para exponer las prácticas que violan sus derechos, y publicar informes para su revisión, y trabajar para su liberación;
3. Liberar inmediatamente a los presos enfermos, niños, mujeres y detenidos administrativos;
4. Abrir las prisiones del Estado ocupante y del apartheid a los comités médicos e internacionales de derechos humanos, incluido el Grupo de Trabajo sobre la Detención Arbitraria;
5. Exhortando a los Estados miembros a los Convenios de Ginebra a que obliguen al Estado ocupante y al Apartheid, en virtud del artículo 1 común, a respetar sus obligaciones en virtud de los Convenios de Ginebra Tercero y Cuarto de proteger a los prisioneros y a los civiles;
6. Se exige a la Comisión de Investigación sobre los Territorios Ocupados que estudie la situación de los reclusos y reclusas en las cárceles del ocupante y que la examine con la Alta Comisionada para los Derechos Humanos en Ginebra;
7. Los Relatores Especiales de la ONU deben ejercer sus responsabilidades en la preparación de informes urgentes y destacando las violaciones de los derechos de los prisioneros palestinos a la salud y la atención, y exponiendo las prácticas del Estado ocupante y del apartheid, de una manera que le permita rendir cuentas y constituya una forma de disuasión;
8. Exigimos a las Naciones Unidas y al Consejo de Derechos Humanos que celebren una sesión extraordinaria para discutir las condiciones de los prisioneros y detenidos palestinos en las cárceles israelíes .

Нижеподписавшиеся правозащитные и гражданские организации самым решительным образом осуждают продолжающееся содержание Израилем под стражей около (4650) палестинских граждан, распределенных по (23) тюрьмам и центрам содержания под стражей. Среди них (32) женщины и девочки, около (180) несовершеннолетних детей в возрасте до восемнадцати лет и (780) административных задержанных, в том числе две женщины и четверо детей. Есть также (600) заключенных, страдающих различными заболеваниями, из них (22) больных раком. Это в дополнение к (549) заключенным, приговоренным к пожизненному заключению один или несколько раз.

Гражданские и правозащитные организации призывают международное сообщество во главе с Организацией Объединенных Наций, Международным комитетом Красного Креста и Рабочей группой по произвольным задержаниям оказать давление на оккупационные власти и заставить их положить конец применению против палестинцев административного задержания. Административное задержание Израилем является нарушением одной из важнейших гарантий справедливого судебного производства, т.к. оно способствует сокрытию информации от задержанного и его адвоката и предоставляет оккупационной администрации возможность бессрочного возобновления административного задержания без ознакомления, задержанного с выдвинутым против него обвинением.
Среди заключенных палестинцев есть около (780) человек, в том числе две женщины и четверо детей, которые задержаны под стражей без предъявления обвинения. А количество ордеров на административное задержание с начала 2022 года по настоящее время достигло примерно (1350) ордеров. Палестинская, арабская и международная общественность требует от израильских оккупационных властей прекращения этой систематической политики, основанной на отмененном колониальном (великобританском) чрезвычайном законе и призывают к самой широкой международной кампании солидарности с палестинскими заключенными вообще и с административными задержанными в частности. Тем более, что с 25.09.2022г. (30) палестинских заключенных объявили голодовку в знак протеста против политики административного задержания и защиты (780) административных задержанных.
Гражданские и правозащитные организации подтверждают, что продолжающееся содержание под стражей палестинских заключенных, которое представляет собой серьезное нарушение международного гуманитарного права, особенно Третьей и Четвертой Женевских конвенций об обращении с военнопленными и задержанными, также является военным преступлением согласно статье 85, пункту 5 Протокола I к Женевским конвенциям, и статье 8 Римского статута Международного уголовного суда. В этих документах подтверждается, что, чему подвергаются палестинские заключенные и задержанные в плане произвольного ареста, физических и психологических пыток, а также жестокого, бесчеловечного и унижающего достоинство обращения и наказания, грубо нарушает международное право в области прав человека, особенно Конвенцию против пыток (1984–1987 годы) , а также стандарты, принятые Рабочей группой по произвольным задержаниям.
Гражданские и правозащитные организации резко осуждают политику медицинского пренебрежения и апартеида, проводимую оккупационным государством в отношении задержанных палестинских женщин, а также политику пыток, одиночного заключения в камерах, где отсутствуют минимальные условия для нормальной жизни, лишения семей заключенных их посещения, а также систематические издевательства и пытки против заключенных мужского и женского пола.
Правозащитные и гражданские организации, подписавшие настоящее заявление, призывают:
1. арабские, региональные, международные государственные и общественные правозащитные организации к работе над интернационализацией проблемы заключенных и административных задержанных;
2. международный комитет Красного Креста к регулярному посещению палестинских заключенных и задержанных, разоблачению практики, нарушающей их права, публикации отчетов для ознакомления международной общественности с их страданием, и активизации деятельности, направленной на их освобождение;
3. немедленно освободить больных, детей, женщин и административных задержанных из под стражей;
4. к принуждению оккупационных израильских властей открыть тюрьмы и центры задержания для миссий международных организаций здравоохранения и правозащитных организаций, включая Рабочую группу по произвольным задержаниям;
5. государства-участники Женевских конвенций обязать оккупационное государство в соответствии с общей статьей 1 соблюдать свои обязательства по Женевским конвенциям III и IV, связанным с защитой пленных и гражданских лиц;
6. комиссию по расследованию на оккупированных территориях изучить положение заключенных мужчин и женщин в тюрьмах оккупантов и обсудить его с Верховным комиссаром по правам человека в Женеве;
7. специальных докладчиков ООН к выполнению своих обязательств по подготовке срочных докладов и освещению нарушений прав палестинских заключенных на здоровье и уход, а также разоблачению практики, применяемой оккупационным государством с привлечением его к ответственности, что может стать орудием сдерживания от продолжения политики геноцида против палестинских заключенных ;
8. Организацию Объединенных Наций и Совет по правам человека провести внеочередную сессию для обсуждения условий содержания палестинских заключенных и административных задержанных в израильских тюрьмах.
